The Fight for Flower

When Florida's medical marijuana program launched, the implementing statute banned smokable flower. The legislature argued that smoking was an inappropriate route of administration for medicine. Patients and advocates challenged this in court, arguing that Amendment 2 did not restrict the form in which cannabis could be consumed.

A Leon County Circuit Court judge ruled the smoking ban unconstitutional in May 2018. After extensive litigation, Governor DeSantis signed SB 182 in March 2019, officially legalizing smokable marijuana flower for qualifying patients. It quickly became the most popular product category in the program.

Current Rules

  • Limit: 2.5 ounces per rolling 35-day period
  • Maximum possession: 4 ounces at any time
  • Separate certification required: Your physician must specifically certify smoking as an appropriate route
  • No minors: Patients under 18 cannot receive smoking certification unless terminally ill
  • 35-day rolling window: Separate from the 70-day window for other products

Potency

Florida has no THC potency cap on flower. Products typically range from 15% to 30%+ THC. All flower must display lab-tested potency on the packaging. New patients should consider starting with lower-potency options and adjusting as needed.

Pricing

Florida flower prices vary significantly by operator and product tier. Ground flower may start as low as $15–$20 per eighth, while premium whole flower can range from $40–$60 per eighth. Many dispensaries run regular sales and first-time patient discounts that significantly reduce costs.

Where You Can Smoke

Smoking medical marijuana is only permitted at private residences. Public smoking is prohibited, and many landlords restrict smoking in rental properties. Patients in rental situations may want to consider vaporization or other non-smokable routes as alternatives.
