No Employee Protections

Can you get fired for weed in Florida? Yes. Florida's medical marijuana law explicitly does not require employers to accommodate the medical use of marijuana. Section 381.986 states that nothing in the statute limits an employer's ability to establish, continue, or enforce a drug-free workplace program or policy. This means:

  • Employers may drug test employees and job applicants
  • Employers may refuse to hire applicants who test positive for THC
  • Employers may terminate employees who test positive, even if the employee holds a valid medical card
  • Employers are not required to allow on-site use or make accommodations

Public Sector Employees

The 2025 legislative session included SB 142/HB 83, which would have provided employment protections for public-sector medical marijuana patients. Both bills died without a committee hearing. As of 2026, public sector employees — including state, county, and municipal workers — face the same lack of protections as private sector employees.

Drug-Free Workplace Programs

Florida's Drug-Free Workplace Act (§440.101–.102) provides employers who implement qualifying drug-free workplace programs with a 5% discount on workers' compensation premiums. Employers participating in this program are required to test employees and applicants, creating an additional incentive for workplace drug testing.

Safety-Sensitive Positions

Certain industries and positions are subject to federal drug testing requirements regardless of state law, including:

  • Commercial motor vehicle operators (DOT regulations)
  • Federal employees and contractors
  • Healthcare workers in certain settings
  • Aviation, rail, and pipeline workers

Before obtaining a medical card, understand your employer's drug testing policy. Some employers are relaxing cannabis testing; others strictly enforce zero-tolerance policies.
