Recreational Cannabis Is Illegal in Florida
Despite receiving 56% of the vote in 2024, Amendment 3 failed to reach the 60% supermajority required for a Florida constitutional amendment. A 2026 ballot initiative also failed to qualify. Possessing cannabis without a valid medical card is a criminal offense in Florida — even small amounts can result in jail time.
