Where Patients Can Consume
Where can you smoke weed in Florida? Medical marijuana patients may use their medicine in private residences only. The state does not have licensed consumption lounges, cannabis cafes, or any public consumption infrastructure. There is no recreational use, so the consumption question applies exclusively to registered medical patients.
Where Patients Cannot Consume
- Public places — Smoking or vaping cannabis in any public space is prohibited
- Workplaces — Employers are not required to accommodate medical cannabis use on their premises
- Schools and universities — Cannabis is prohibited on all educational institution grounds
- Federal property — All military bases, federal buildings, national parks, and federal courthouses
- Motor vehicles — Consuming while driving or as a passenger is illegal; HB 1003 (2026) proposes additional open container restrictions
- On MMTC premises — Patients may not consume products at the dispensary
Smoking vs. Non-Smokable Routes
Smokable flower was only legalized in 2019 after a legal challenge. It requires a separate physician certification for smoking as a route of administration. Non-smokable routes — including vaporization, edibles, tinctures, topicals, and capsules — are available to all qualified patients. Many landlords and property managers prohibit smoking cannabis in rental properties, even for medical patients.
Rental Properties and HOAs
Landlords in Florida are generally permitted to prohibit smoking of any substance, including medical marijuana, in their rental properties. However, many patients can still use non-smokable routes of administration such as tinctures, edibles, and topicals. Patients should review their lease agreements and consider discussing accommodation with their landlords.
Traveling with Medical Cannabis
Registered patients may transport their medical marijuana in Florida, but products should remain in their original dispensary packaging. Cannabis may not be taken across state lines under any circumstances — even to states where cannabis is legal. Florida does not recognize out-of-state cards, and no other state recognizes Florida's card for reciprocal purchases.
